For every Bankruptcy case that is filed, pursuant to 11 U.S.C. 341, a mandatory hearing is required where the individual person that is filing (i.e. Debtor) or a representative of the Debtor if the Debtor is a business, must appear and testify at what is coined as the 341 Hearing. This hearing is where the assigned trustee will question the Debtor about the pleadings filed in the case along with the documents provided to the Trustee’s office. For chapter 7 cases, the Trustee’s job is to ensure the documents are filed with accuracy, whether the Debtor actually even qualifies to do the Chapter 7, and then ultimately determine whether they will be liquidating any of the Debtor’s assets---and if there are assets to liquidate, the Trustee will do so. In a Chapter 13 case, they again need to ensure the documents are accurate and the person qualifies for the Chapter 13. In addition, the Trustee will examine the file and question the Debtor to assess whether the Chapter 13 payment plan is the correct amount that they should be paying.
